By accessing and using Elite Tours ("Platform," "we," "our," or "us"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with these terms, please do not use our services.

2. Platform Description

Elite Tours is a platform that connects travelers with verified local guides, event organizers, and safari operators for authentic experiences, tours, and activities. We facilitate bookings but do not directly provide guide services.

3. User Accounts

3.1 Registration

• You must be at least 18 years old to create an account
• You must provide accurate and complete information
• You are responsible for maintaining account security
• You must not share your account credentials

3.2 Account Termination

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

4. Booking and Payment Terms

4.1 Booking Process

• All bookings are subject to guide availability
• Prices are displayed in both USD and KES
• Payment must be completed to confirm booking
• You will receive booking confirmation via email

4.2 Payment

• We accept M-Pesa, credit/debit cards, and PayPal
• All payments are processed securely through third-party processors
• Service fees are clearly displayed before payment
• Currency conversion rates are applied at time of booking

4.3 Pricing

Prices are set by guides and may vary. All prices include applicable taxes unless otherwise stated. Service fees are added at checkout.

5. Cancellation and Refund Policy

5.1 Tourist Cancellations

• 24+ hours before: Full refund minus service fee
• 12-24 hours before: 50% refund
• Less than 12 hours: No refund

5.2 Guide Cancellations

If a guide cancels, you will receive a full refund or can rebook with another guide.

5.3 Force Majeure

In cases of natural disasters, political unrest, or other unforeseeable circumstances, special cancellation terms may apply.

6. User Conduct

Users agree to:

• Treat guides and other users with respect
• Arrive on time for booked experiences
• Follow local laws and customs
• Not engage in illegal activities
• Provide honest reviews and feedback
• Not harass, threaten, or discriminate against others

7. Guide Responsibilities

Guides on our platform must:

• Complete verification process
• Provide accurate service descriptions
• Maintain appropriate licenses and permits
• Ensure tourist safety during experiences
• Honor confirmed bookings
• Maintain professional conduct

8. Liability and Disclaimers

8.1 Platform Role

Elite Tours acts as an intermediary platform. We do not employ guides and are not responsible for their actions or the quality of services provided.

8.2 Limitation of Liability

To the maximum extent permitted by law, Elite Tours shall not be liable for:

• Injuries or accidents during experiences
• Loss or damage to personal property
• Guide misconduct or service quality issues
• Indirect, incidental, or consequential damages

8.3 Insurance

We strongly recommend tourists obtain travel insurance. Guides are required to maintain appropriate liability insurance.

9. Intellectual Property

All content on Elite Tours, including text, graphics, logos, and software, is our property or licensed to us. Users may not reproduce, distribute, or create derivative works without permission.

10. Reviews and Content

10.1 User-Generated Content

By posting reviews, photos, or other content, you grant us a non-exclusive, worldwide license to use, display, and distribute that content.

10.2 Content Standards

Content must be:

• Honest and based on actual experience
• Respectful and non-discriminatory
• Free from profanity and offensive material
• Not promotional or spam

11. Privacy

Your use of the platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

12. Dispute Resolution

12.1 Communication First

We encourage users to resolve disputes directly with guides through our messaging system.

12.2 Platform Mediation

If direct resolution fails, contact our support team for mediation assistance.

12.3 Governing Law

These terms are governed by the laws of Kenya. Any disputes shall be resolved in Kenyan courts.

13. Modifications to Terms

We reserve the right to modify these terms at any time. Significant changes will be communicated via email. Continued use of the platform after changes constitutes acceptance.
