Talent Acquisition Terms & Conditions

1. Overview

These Talent Acquisition Terms & Conditions ("Terms") govern applications, onboarding, and continued participation of individuals ("Guides" or "Candidates") seeking to provide guiding services through Elite Tours ("Elite", "we", "us", "our"). By applying to become a Guide, you agree to these Terms, our Privacy Policy, and applicable laws including the Kenya Data Protection Act, 2019 and, where relevant, the EU/UK GDPR.

2. Eligibility

• Minimum age: 18 years.
• Valid identification and, where required, relevant licenses or permits.
• Ability to communicate effectively in languages served and provide safe, lawful experiences.

3. Application Materials

• Accurate personal information, resume/CV, and social presence details.
• Introductory video (up to 1 minute) describing your suitability.
• References may be requested to verify experience and professionalism.

You grant Elite a non-exclusive, royalty-free license to use application materials (including the introductory video and profile content) for evaluation and marketing of your services on our platform, subject to applicable laws and your privacy rights.

4. Verification & Background Checks

Subject to consent and applicable laws, you agree that Elite may conduct identity verification, document checks, and background screening (including criminal record checks where lawful), and may contact provided references. Refusal to consent or failure to pass verification may result in rejection or removal.

5. Non-Discrimination & Conduct

• Elite is an equal opportunity organization. Discrimination based on race, color, religion, gender, sexual orientation, national origin, disability, or other protected characteristics is prohibited.
• Guides must adhere to local laws, safety standards, and respectful conduct with all clients and communities.
• Harassment, fraud, unsafe practices, or misrepresentation may lead to immediate suspension or termination.

6. Independent Contractor Status

Guides operate as independent contractors, not employees or agents of Elite. You are responsible for your taxes, insurance, permits, and compliance with applicable regulations. Nothing in these Terms creates an employment relationship.

7. Service Standards

• Provide accurate descriptions of services, pricing, and availability.
• Maintain safety protocols and ensure experiences are lawful and culturally respectful.
• Respond promptly to client inquiries and booking communications.

8. Payments & Fees

Payment terms, commissions, and payout schedules (if applicable) will be outlined in your onboarding agreement or platform policies. You agree to transparent pricing and to honor confirmed bookings. Elite may withhold payouts for suspected fraud or unresolved disputes.

9. Content & Intellectual Property

You retain ownership of your content. By submitting content to Elite, you grant us a non-exclusive license to display, distribute, and promote it on our platform and marketing channels. You warrant that content does not infringe third-party rights.

10. Data Protection

We process personal data in accordance with the Kenya Data Protection Act, 2019 and, where applicable, GDPR. See our Privacy Policy for details, including lawful bases, rights, retention, and data sharing with service providers.

11. Safety & Compliance

Guides are responsible for ensuring all activities are safe, compliant with local laws, and suitable for clients. You must disclose material risks and obtain any necessary permissions or permits for activities.

12. Termination & Suspension

Elite may suspend or terminate your participation for violations of these Terms, safety concerns, legal non-compliance, or reputational harm. You may request removal at any time by contacting support. We may retain records as required by law.

13. Disputes & Complaints

Disputes between Guides and clients should be reported promptly. Elite may mediate where feasible but is not a party to service contracts between Guides and clients unless expressly stated.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of Kenya. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of Kenyan courts, unless otherwise required by applicable consumer protection laws.

15. Changes to Terms

Elite may update these Terms to reflect changes in laws or business practices. We will indicate the effective date and provide notice of material changes as appropriate.

16. Acceptance

By submitting your application and checking the required consent boxes, you acknowledge and agree to these Terms and the Privacy Policy.
